About Mediation

WHAT IS MEDIATION?

Mediation is an Alternative Dispute Resolution (ADR) process that helps the business community settle commercial disputes without resorting to long and expensive judicial process or arbitration. It is always consensual whether agreed upon by the parties in their contracts or ordered by a Court or Tribunal (judicial mediation). Mediation has indeed many advantages:

  • Fast, Informal and flexible
  • Cost effective
  • Controlled by parties
  • Parallel to litigation or arbitration
  • Maintains business relationships
  • Varies the settlement options

Mediation has been integrated within LAMC since 2012 through a cooperation agreement signed between the Chamber of Commerce, Industry and Agriculture of Beirut and Mount Lebanon and the International Finance Corporation (IFC), an international organization member of the World Bank Group, for the development and promotion of commercial mediation in Lebanon.

LAMC covers training and accreditation of mediators, conducting commercial mediation cases and raising awareness on the benefits of mediation. LAMC appoints mediators, offers facilities for the conduct of mediation sessions, prepares mediation agreement and coordinates mediation logistics.

MEDIATION CLAUSE

Parties wishing to submit their contractual relationship to mediation under the LAMC Mediation Rules shall insert the following clause in their contracts:

In the event of any dispute arising out of or in connection with the present contract, the parties agree to submit the matter to mediation proceedings under the Rules of Mediation of the Lebanese Arbitration and Mediation Center of the Chamber of Commerce, Industry and Agriculture of Beirut and Mount Lebanon Mediation Procedure. Unless otherwise agreed between the parties, the mediator will be nominated by LAMC”.
